Dealing with the Evolution in Checks
For decades the use of checks was essentially unchanged. Checks are have been - and remain - a foundation method of paying for goods and services. But in the recent past significant changes have occurred that have changed the use of checks. They have even changed checks themselves.
For prosecuting attorneys and the entire legal system, these changes have created challenges and have required courts and proscutors to adjust to handling bad checks that enter the system. The federally mandated CHECK 21 (Check Clearing Act for the 21st Century) and e-checks have not eliminated the ability of check writers to issue bad checks but they have eliminated the ability of prosecutors to present an actual, physical document in a court proceeding. Signature verfication has been drastically changed. And several other aspects of pursuing bad checks has required new ideas and techniques.
